Buyer's purchase order is subject to the exclusive use of the terms of buyer's purchasing conditions , the basic purchase agreement where applicable, as well as the attachments and specifications incorporated or attached hereto by the buyer. Said terms, which supplier agrees to by acknowledgement of order, commencement of performance or delivery of any item, constitute the entire contract. Any acknowledgement hereof shall be deemed an acceptance of these terms. Terms in supplier’s acceptance, which are contradictory or additional to buyer’s terms, will not become part of the contract.
